TERMS & CONDITIONS

Article 1 - General

This Terms and Conditions govern the sales of Aura Marketing Sdn Bhd (Aura) made on its commercial website via www.academiebeaute.my and restricted only to individual buyer (Customer).
The below Terms and Conditions are intended to define the rights and obligations of both Aura and the Customer.
Aura reserves the right to modify these Terms and Conditions at any time.
The Customer is deemed to have read and accepted the Terms and Conditions by receipt of this notice.

Article 2 - Sale of Product

Product Availability
Aura undertakes that the Products delivered shall correspond with the description displayed on the website. If the buyer wishes to obtain qualified advice on the Products, a Customer Service shall be made available.
For the duration the Product is present on the website, it remains on offer, subject to stock availability.
In an event of unavailability of a Product where an order has been placed, a notification email will be sent to the Customer.
Customer shall be entitled to a partial refund, for an incomplete delivery; or a full refund, upon order cancellation. The refund will be made within 30 days via the website where initial transaction is executed.

Product Order
To purchase a Product, Customer shall access his/ her account on the website.

Warranties & After Sales Service
Aura guarantees that all Products delivered are of an acceptable quality. In an event the Product is deemed defective, the Customer shall exercise the right to seek refund or replacement within a reasonable time.
Customer may lodge a complaint to Customer Service through the following:

A Product replacement is only available if the Product delivered fails to conform to the specifications of the order initially placed.

Article 3 - Order

An order is deemed to be executed upon the validation of payment and acceptance of the Terms & Conditions herewith. All data related to an order will be stored by Aura as proof in relation to the Product purchased and date the order is performed.
An electronic signature submitted by the Customer constitutes a valid signature. The acceptance of the Terms & Conditions herewith upon the submission of the electronic signature is irrevocable.
The sale is only deemed concluded upon the delivery of a confirmation order by Aura and the payment of the order by the Customer.
Aura reserves the right to cancel any order made by the Customer if a payment for a prior order from the Customer has yet to be paid in full.
Customers will be able to track the development of his/ her order in their respective accounts.

Article 4 - Price

All prices are in Ringgit Malaysia (RM) and is inclusive of all taxes. This excludes shipping and processing costs.
The title to the Product shall only be transfer to the Customer upon payment made.
All promotional offers are only valid for the duration it is advertised on the website.

Article 5 - Loyalty Program

To participate in the Loyalty Program, Customers shall create an Academie & Me account. 20 points will be credited upon the creation of the account.
Points will be awarded for each order made. 1 point will be credited into the account for each RM1 spent. Delivery cost is excluded in the calculation for points.
Customers shall be entitled to a RM20 discount for any purchase upon accumulating 2000 points.
2000 points will be deducted on the utilisation of the abovementioned discount.
All points awarded is not limited by time. Customers can redeem the points throughout the duration of the account, Academie & Me remains active. The points are not available to be redeem for any refund seek by Customers mentioned in Article 2. Points can only be remitted to Customers for refunds for purchase made in which the discount is utilised.

Article 6 - Payment

An order can be paid online on the website. We accept the following methods:
Visa, Master, Debit card, Online Banking

Aura reserves the right to suspend an order in an event of a non-payment or a failure by the relevant financial institutions to authorise the transaction.
Aura cannot be held responsible for any fraud or misappropriation within the payment process in which the verification procedure does not detect. Customer guarantees that he/ she has the necessary authorization to make the payment with the method chosen.

Article 7 - Security of Payment

In making a payment, Customers shall provide his/ her CCV at the back of his/her card. Transactions on the website is secured by SSL encryption protocol. Data processed in the course of payment can neither be detected nor intercepted by third parties.

Article 8 - Shipping & Delivery

Delivery is limited to Malaysia. Orders received within Monday to Friday will be processed within the same day or the next business day. Orders received on Public Holiday, Saturday and Sunday will only be processed on the next business day.

Aura undertakes to deliver orders within 5 to 10 working days of receipt of order. In any event, Aura agrees to deliver the order within 30 days of receipt of order.
Aura shall be liable hereunder only for its own gross negligence, wilful misconduct or bad faith.

Aura cannot be held responsible for any delay in delivery due to force majeure circumstances.

Upon receipt of delivery, the Customer shall:
a) Lodge a complaint to the delivery agent or to refuse the package if the package has been damaged or compromised in any manner;
b) Report the incident to Customer Service (refer to Article 2)

Time is of the essence. The abovementioned steps shall be carried out without delay, within 3 working days of the receipt of delivery.
Aura shall refund the Customer within 30 days of receipt of the returned package.
Unless specified by the Customer, all order delivered is deemed to be in good condition and shall not be subjected to subsequent dispute.

Article 9 - Returns

We gladly accept exchangeable, returnable or refundable unless due to manufacturing or shipping defect. Should you encounter item(s) with manufacturing or shipping defects, kindly contact us at onlinestore@auraskincare.com.my within 3 working days from the date receipt. Returns due to the exercise of the right of withdrawal must in all cases be made to the following address:

The product must be returned in their original packaging, with their accessories, their instructions, in a perfect state of resale, and accompanied by the return voucher available in the account Academie & Me of the buyer heading "My Orders" at the line the order concerned.

If the return concerns a box, the whole of it must be returned to us.

Upon receipt of your email, we will respond to your request within 3 working days.

Shipping costs return the package remain the responsibility of the buyer. The buyer is advised to keep proof of his/her return. Upon approval; return your item(s) for a replacement at any GD Express Sdn. Bhd. branches. A replacement product (subject to availability) or product of the similar value will be shipped within a minimum of 14 working days upon receiving your defective item(s).

Refund of returned items will be made within thirty (30) days of receipt of the returned order. The buyer will be informed of the good reception of the return by e-mail. The refund will occur on the account associated with the credit card or bank account used to make payment.

Article 10 - Exclusion

Aura cannot be held responsible for any indirect damage that may occur due to the purchase of Products.
Aura cannot be held responsible for the non-execution of the order in case of unavailability of Products due to force majeure as defined by the applicable laws.
Aura cannot be held liable for any damages as a result of the intrusion or viruses of the internet service.

Article 11 - Personal Data Protection

The personal data of the buyer and any recipients of his orders collected by the company are required to process orders. Aura collects and manages this information in accordance with the Personal Data Protection Act 2010. The Customer has a right to access, rectify, delete and oppose his personal data.

The Customer can exercise this right by sending an email to onlinestore@auraskincare.com.my specifying in the subject of the email "Personal Data", by contacting our customer service at 03-5569 4420, Monday to Friday from 10 am to 6 pm or by mail to the following address:

The buyer shall indicate his/ her surname, first name and address and the subject of the request.

Article 12 - Intellectual Property

The website www.academiebeaute.my and each of the constituting elements, including brands, logos, photographs, images, illustrations, texts, slogans, video is the exclusive property of Académie Scientifique de Beauté SAS.

Any reproduction and / or full or partial representation, use, adaptation or modification of the website or any of the elements that compose it on any medium whatsoever, and in any form whatsoever, for other purposes especially commercial, is expressly prohibited.

Article 13 - Governing Law

This Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.

Article 14 - Dispute Resolution

Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be decided by the competent courts and tribunals of Malaysia.
